Terms & Conditions of Contract
Please read below and sign, indicating your agreement.
1. PHOTOGRAPHY SESSION ORDER:: This signed contract constitutes an order for photography in the form of high-resolution digital images and/or prints. There are no oral or other agreements of the parties hereto, and this contract constitutes full and complete understanding and agreement between the Client and Photographer.

2. LIMIT OF LIABILITY:: Although care will be taken with the digital files, the Photographer limits any liability for loss, damage, or failure to deliver photographs for any reason of photographer's non-performance caused by any force or similar circumstances, illness, accident, or any cause beyond their control. In any event, the limit of Photographer's liability shall not exceed the contract price stated herein.

3. OWNERSHIP OF DIGITAL FILES:: It is agreed that dual ownership of the purchased digital files will be maintained by the Client and the Photographer. Upon delivery of the digital files to Client's physical control, the client shall gain personal non-commercial rights to the purchased images. The Photographer does NOT guarantee archival of the digital files past a period of six months after the session/event date and will not be held responsible if loss occurs as per section 1.

5. SESSION FEE:: Upon signature and payment of the session fee, the Photographer reserves the time and date agreed upon and will not make other reservations for that time and date. For this reason, the session fee is non-refundable, even if the photo-session or event is cancelled for any reason. Sessions can only be rescheduled one time at no cost.

6. GUARANTEED DELIVERY:: Photographer agrees to have a proofing gallery complete within two weeks of the event date.

7. EMPLOYMENT: This contract is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor.

I understand that the deposit of $175 reserves the date and time for the event and pays for the first hour of photography. The remaining balance is due on the event date. Clients booking the three-hour minimum, for example, pay the $175 deposit at the time of booking and then the remaining $350 (2-hours) on the event date.

I understand that approximately 50 images will be chosen and edited from each hour of photography. Event photography does not include retouching, but it does include color and exposure correction.

I understand that the images will be available for download for ten days and that extensions of the gallery will incur a convenience fee of $30 per extension.
I understand that the deposit of $300 reserves the date and time, and the remaining $700 is due by the date of the birth.

I understand that approximately 150 images will be chosen and edited from the birth, including active labor, delivery, and the hour after birth. Event photography does not include retouching, but it does include color and exposure correction.

I understand that the images will be available for download for two weeks and that extensions of the gallery will incur a convenience fee of $30 per extension.

I understand that I may optionally purchase a custom-designed photo album through Amy Gray Photography after the event. Albums are priced at $400 (50 pages) and $700 (100 pages).
